Todd BeardIf Tom Atencio is Affliction’s Dr. Jeckyll, then Todd Beard is without a doubt Affliction’s Mr. Hyde. Since Randy Couture re-signed with the UFC, we’ve learned that Beard, one of Affliction’s co-founders, has quite the temper when it was reported that Beard had cussed out Lorenzo Fertitta on a conference call, and subsequently appeared on Scott Ferrall’s radio show where he blasted the UFC, Lorenzo, Dana White, and Randy Couture. There were also rumblings of personal attacks on Randy’s wife, Kim, which judging by the latest news appears to be true.

According to a report on (via Bloody Elbow), Kim Couture has filed a temporary restraining order against Beard.

Randy and wife Kim claim Affliction Prez Todd Beard has been on a campaign of terror against them since they asked for an accounting of profits. A Las Vegas judge just issued a temporary restraining order, prohibiting Beard from going near Kim, and that includes going near the MGM Grand when Randy fights this Saturday. And Beard can’t go to the hotel during the weigh-in the day before either.

According to Kim Couture’s declaration, Beard has made “a series of threats and acts intended to intimidate me and otherwise coerce me to ‘back off.'”

She goes on: “My fear of Mr. Beard is well-founded given his extensive criminal history. Not only has he been convicted of numerous state and federal felonies relating to fraud …he has engaged in numerous acts of violence, including violence against women.”

MMA Payout has more on Beard’s alleged criminal past.

In support of this request, the complaint includes a summary of a private background check on Beard. The background check allegedly discovered Beard to be a five-time felon with prison and jail time served. Among the offenses Beard allegedly committed are forgery, fraud, domestic abuse, and DUI. The complaint also alleges that Beard appeared in a Los Angeles court room just last week on a charge of threatening another’s life.

Wow, this story went from shouting obscenities to serious allegations and court intervention fast. It’s probably safe to say Affliction’s relationship with the Couture’s is all but officially over.

I’m quite certain we haven’t heard the last of this story. We’ll keep you posted.

[UPDATE 11/12/08 7:07PM ET]MMA Payout posted an article with more details on the Couture-Beard situation, including more details on Beard’s criminal history. They also mentioned this.

In an interesting twist, has learned that Donald J. Campbell is serving as Couture’s local attorney in the matter. Campbell is a highly respected Las Vegas attorney who became familiar in MMA circles last year for his representation of the UFC in its dispute with Randy Couture. His involvement is sure to raise eyebrows.

Funny how things come around.

[UPDATE 11/13/08 11:36AM ET]Bloody Elbow has a post up about Todd Beard’s involvement in a scam that defrauded senior citizens across the nation for a grand total of $10 million in the early nineties. In terms of fraud, ripping off the elderly is about as low as it gets.

Also, Kevin Iole believes these revelations will likely cause Affliction their partnership with Donald Trump.

Beard served 30 months in a federal prison from 1993-95 after pleading guilty to three felony counts, of conspiracy, wire fraud and mail fraud. Those felony convictions may end billionaire Donald Trump’s association with Affliction’s MMA promotional company. Trump holds a gaming license in New Jersey and gaming licensees are not permitted to do business with felons.

Quite honestly, if this is news to CBS/Showtime, Golden Boy and whoever else Affliction is attempting to partner up with these days like it has been for the rest of us, I would expect this would kill those deals too. Why would any reputable organization want to be tied to a company run by a career criminal?

[UPDATE 11/13/08 2:24PM ET] – In the interest of fairness, Todd Beard’s lawyer is denying the allegations that led Kim Couture to file for the restraining order.

According to Kim Couture’s declaration, Beard has made “a series of threats and acts intended to intimidate me and otherwise coerce me to ‘back off.'”

Beard’s lawyer, Michael Bassiri of Newport Beach, called allegations that Beard threatened Couture “complete nonsense.”

“I think they took his statements incorrectly that there was any sort of physical harm implied,” Bassiri said. “He didn’t threaten them. It was only regarding a business relationship.”

Hmmm…who to believe?
